Topic: iTunes? Revenue?

Noticed this at http://staging.loudcity.com/broadcast:

# Participation in directories and devices, such as, but not limited to iTunes, iPhone and Windows Media Guide, must be arranged by LoudCity

and

#Non-revenue generating, with exception of revenue generation through LoudCity affiliations

Am I mistaken in that these two things mark changes in the TOS for Loudcity?   So, no more iTunes listings?

And, no more Amazon affiliations, etc?   Banner ads, too?

We haven't reworked the TOS yet., but we're very accommodating do the needs of current customers and try not to rock the boat for you.. But yes, new rules for new people to address a lot of gray areas in all the various contracts we have with copyright owners.

Thanks - I'm sure you will do your best (you'all always have).  I was just surprised to see that on the staging site.

It's not a meaningless control thing for the sake of control. What we're going to and up doing is have a submission form for all the various directories, and we'll send along a consistent set of load balanced playlist file urls to the directory. This should help not only help the broadcasters get into directories, but help them stay in.

I think we'll ask RadioTime and others to carry all the url's too. I made a Loudcaster.com feed for them, and it worked out very well. My mother got a Logitec Squeezebox Boom for Xmas, and all the Loudcaster channels just appeared in it, out of the box. This would be amazon for LoudCity customers too.

so does this mean those of us not on windows media guide and other directories will have an easier time signing up for those directories?

I was pretty well in shock at how fast they got back to me...  & then I got up this morning & my puny little 10 slots were FULL.  I've gone up to 30 slots, & I'm still beating listeners off with a stick!  I should have done this YEARS ago... 

NOW: to pay for all these new listeners!  :-)

iTunes has been pretty fruitful lately. Not more than a year ago listeners were not as abundant.

Being in Colorado, we won't have to worry about how new TOS affects us regarding Amazon.  They have dropped all Colorado Associates due to a newly passed online sales tax law passed by Colorado.  Just recieved word they have closed the station account as of today.

I've so far never run any ads or received a donation or anything, but if these conditions are introduced, sorry, I'd have to leave Loudcity (reluctantly):

LoudCity does not work with commercial clients. Our mission is to help the small micro-caster operate as smoothly and profressionally as possible through great community and support.

If you want LoudCity to include your channel in our own webcasting license, your channel must meet the following requirements:
1.Be operated as a personal hobby, public school or college broadcast
2.Non-revenue generating, with exception of revenue generation through LoudCity affiliations
...

Looking at the spelling etc, the writer was somewhat tipsy when he wrote this and all is well...

How is that gonna work with things like quid pro quo advertising?

They don't generate a dime in true revenue but gives you rights to broadcast, use images, maybe the company in question pays for x slots on your broadcast server.  (These are all things currently working on so need to know).

Amazon...yeg... I'm in colorado that one still ticks me off, haven't had the time yet to yank their banner ads off not that I ever made a penny off of them.

Also that above mentions a loudcity affiliate program.  I'm at work so can't go browsing for it, but I don't remember it when I signed up.  Can someone post a link to it?

Couple of last questions.

The link is for the new staging site and it's rules.  Is that the way everything is going and if so what happens to existing listings on things like iTunes (I have the app filled out just hadn't sent it out and now don't know if I should).

What about the traditional paypal donations link on our web pages?  That's revenue generation.  It's not like any of us are close to breaking even but most of us do get small donations once in a while... are those allowed?

Having been around these parts for a few, I don't stay up late worrying whether Brandon/LC staff are gonna done anybody.
It's not within character for this great organization to not consider the very best for each of us; whether we be rookie or vet.

This seems to say that existing stations aren't bound to this, yet. New sign ups are. I am assuming that pre-existing stations that are paying the additional license to run commercials are exempt from this. I'd also think that stations that are already in such directories would be exempt. Usually LC grandfathers in stations per the terms of their original sign up. I would only ask is the granfathering going to apply to the new TOS, or is that going to be ironclad for all. I understand that licensing has to be renegotiated at certain intervals. There are several affected areas for instance if you run 3rd party services like ABC news that includes commercial content. That could no longer be allowed.

Just my thoughts

It takes annual plans and a lot of neglect to be like live365, (Edited by Brutish Sailor: Nothing was that everyone doesn't already know)

This in the long run, is a good idea.  It makes it easier for Brandon to protect us in the long run from those that would attempt to "squeeze blood from a turnip" so to speak, and there are a couple of broadcasters always, when it comes to profit understandings, that JUST DON'T GET IT. Less trouble with Loudcity broadcasters means it would be easier via credibility and reputation, to get us listed into a massive amount of reputable directories. 

Oh yeah, Hey everyone. Still in Iraq, and Iraq still is about as much fun as mutilating my face with a tack hammer. Hope everyones doing all right.
